Abstract

This study provides a comprehensive analysis of the right of children to nationality in Namibia, focusing on the human rights implications of statelessness, the role of cultural factors in shaping national identity, and the intersection of legal frameworks with social and cultural norms. While Namibia has made notable strides since its independence in 1990, the issue of statelessness among children persists as a significant challenge. This research examines the existing legal and institutional measures in place to combat statelessness, while also exploring the complex cultural and societal factors that influence the recognition of nationality in Namibia. Through qualitative methods, including in-depth interviews with key stakeholders from UNICEF, the Ministry of Justice, the Ministry of Gender Equality, Poverty Eradication and Social Welfare, and the Ministry of Home Affairs, Immigration, Safety and Security, the study uncovers both the progress and limitations of current efforts. These efforts include public awareness campaigns, improvements in birth registration, and collaborative initiatives with international bodies. However, the findings highlight critical gaps in Namibia’s legal framework and the country’s reluctance to fully embrace international conventions on statelessness. A key factor identified is the role of cultural conceptions of nationality, which can often overshadow legal provisions, leaving certain children excluded from formal recognition as nationals. The study argues that while Namibia has taken steps toward addressing statelessness, these efforts are insufficient without a more holistic approach that integrates both legal and cultural understandings of nationality. The research emphasizes that overcoming statelessness among children is essential not only for safeguarding their human rights but also for promoting social inclusion, national cohesion, and cultural belonging. It concludes with recommendations for legal reforms, including the adoption of international standards on statelessness, Namibia’s accession to key Statelessness Conventions, and the establishment of comprehensive mechanisms to ensure that every child is granted a legally recognized nationality, irrespective of their cultural background or status.
